This document (hereinafter referred to as the "Offer") is a public offer by Bugaev David (hereinafter referred to as the "Administrator") to provide access to the functionality of the BilateralBound website (hereinafter referred to as the "Site"), located at https://emdrbilateral.ru/, on the terms described below.
This Offer is governed by Article 437 of the Civil Code of the Russian Federation and constitutes a legally binding agreement between the Administrator and any person who accepts this Offer (hereinafter referred to as the "User").
By using the Site, creating sessions, or subscribing to paid services, the User confirms full and unconditional acceptance (acceptance) of this Offer.
For the purposes of this Offer, the following terms have the meanings set forth below:
The Administrator provides the User with access to the functionality of the Site — a platform for conducting EMDR therapy sessions using bilateral stimulation.
The Site provides the following services:
Acceptance of this Offer is considered from the moment the User performs any of the following actions:
Acceptance of this Offer means that the User agrees to all its terms without exception. If the User does not agree with any term, they must immediately stop using the Site.
The following services are provided free of charge: creating EMDR sessions with random identifiers, conducting real-time bilateral stimulation sessions, and basic session management features.
Free sessions are temporary: session data is stored in the server's RAM and may be deleted after 24 hours of inactivity or when the server is restarted.
The Administrator reserves the right to limit the number of free sessions and change the terms of free services at any time.
The Supporter subscription provides the User with access to additional features: permanent custom session links with personalized identifiers, priority technical support, and other features specified on the Site. The payment also supports the ongoing development and hosting of the BilateralBound platform.
The cost of the Supporter subscription is 75 ⭐ Telegram Stars for 30 (thirty) days. Payment is made via Telegram Stars (internal Telegram currency).
The Supporter subscription is valid for 30 (thirty) calendar days from the payment date. Renewal requires a new payment — there is no automatic recurring charge.
The User has the right to cancel the Supporter subscription at any time. Upon cancellation, the subscription remains active until the end of the paid period, with no refund for unused funds unless otherwise provided by law.
Payment for the Supporter subscription is processed through the Telegram payment system. The Administrator does not process, store, or transmit payment data.
The Site is provided on an "as is" basis. The Administrator makes no warranties regarding uninterrupted or error-free operation of the Site or the achievement of therapeutic results.
The Administrator shall not be liable for any direct or indirect damages arising from the use or inability to use the Site, including but not limited to: data loss, lost profits, disruption of therapy sessions.
The User bears full responsibility for using the Site in their professional practice, including compliance with professional standards and legal requirements.
The Administrator's liability to the User for claims arising from the use of the Site is limited to the amount paid by the User for the Premium subscription in the 30 (thirty) days preceding the claim.
The Site is a technical tool for bilateral stimulation and is NOT a certified medical device. EMDR therapy sessions should be conducted exclusively by qualified mental health professionals.
The Administrator is not a medical organization and does not provide medical services. The Site does not diagnose, treat, or prevent diseases.
The User acknowledges that they use the Site at their own risk and the Administrator is not liable for the consequences of using the Site for therapeutic purposes.
The processing of personal data is carried out in accordance with the Privacy Policy, available at https://emdrbilateral.ru/privacy, which is an integral part of this Offer.
By accepting this Offer, the User confirms that they have read and agree to the terms of the Privacy Policy.
All disputes arising from this Offer shall be resolved through negotiations. If agreement cannot be reached, disputes shall be resolved in accordance with the current legislation of the Russian Federation.
The place of dispute resolution is the location of the Administrator: the Russian Federation.
The Administrator reserves the right to unilaterally change the terms of this Offer. Changes take effect from the moment the updated Offer is published on the Site.
Continued use of the Site after changes to the Offer means the User's acceptance of the new terms. If the User does not agree with the changes, they must stop using the Site.
This Site is operated by an individual and is not a legal entity in accordance with the legislation of the Russian Federation.
